Title VI Policy Notice to the Public

The Arc Gloucester operates its programs and services without regard to race, color, or national origin in accordance with Title VI of the Civil Rights Act of 1964 as amended.  Any person who believes that she or he has been aggrieved by any unlawful discriminatory practice under Title VI may file a complaint in writing to the Director of Human Resources of The Arc Gloucester.  To file a complaint, or for more information on The Arc Gloucester's obligations under Title VI write to: The Arc Gloucester, 1555 Gateway Blvd., West Deptford, NJ 08096, or visit thearcgloucester.org.  Transportation services provided by this agency are in whole or part funded through federal funds received through NJ TRANSIT and as an individual you also have the right to file your complaint with the Federal Transit Administration by writing to: Title VI Program Coordinator, East Building, 5th Floor – TCR, US Department of Transportation, FTA, Office of Civil Rights, 1200 NJ Avenue, SE, Washington, DC 20590.

NOTE:  This information is posted in all FTA funded vehicles used to operate The Arc Gloucester RLC Transportation program, on The Arc Gloucester website and in all employee and passenger handbooks.  


This section outlines the Title VI complaint procedures related to providing programs, services, and benefits.  However it does not deny the complainant the right to file formal complaints with the New Jersey Human Relations Commission, federal Transit Administration, or seek private counsel for complaints alleging discrimination, intimidation or retaliation of any kind that is prohibited by law.

Title VI of the Civil Rights Act of 1964 prohibits discrimination on the basis of race, color, or national origin in programs receiving federal financial assistance.


Any person who believes that he or she has been discriminated against on the basis of race, color, or nation origin by The Arc Gloucester's Human Resource Department or Title VI Coordinator of the specific department concerning the complaint, 1555 Gateway Boulevard, West Deptford, NJ 08096.  Complainants have the right to complain directly to the appropriate federal agency.  Every effort will be made to obtain early resolution of complaints.  The option of informal meetings between the affected parties and the Title VI coordinator may be utilized for resolutions.  The Human Resources Manager will inform the Executive Director of all title VI related complaints as well as all resolutions. A person may also file a complaint directly with the Federal Transit Administration, at FTA Office of Civil Rights, 1200 New Jersey Avenue SE, Washington, DC 20590.


The Arc Gloucester shall have in place procedures for reporting, investigating, and where appropriate, the remediation of claims of discrimination.  Such investigations shall be conducted in a prompt, thorough and impartial manner.

The procedures ensure that all who believe they have been or are being subjected to discrimination should:

  • Report the incident(s) to the Director of Human Resources, or any other appropriate designee within 180 days of the alleged occurrence.  Complaints must be in writing and signed by the individual or his/her representative, and should include the name, address and telephone number, name of the alleged discriminator(s), basis of complaint (race, color, national origin) and the date(s) of the alleged act(s).
  • If a complaint of discrimination is received by any supervisor, the supervisor shall report the complaint immediately to the Director of Human Resources, or any other appropriate designee.
  • The Director of Human Resources will provide written acknowledgement to the complaint within 10 business days.  The Executive Director and Assistant Executive Directors will be copied on all correspondence.
  • Within 20 business days from receipt of a complete complaint the Director of Human Resources will meet with the Executive Director and/or an Assistant Executive Director to determine its jurisdiction in pursuing the matter and whether the complaint has sufficient merit to warrant an investigation.
  • If the complaint has investigative merit, the Director of Human Resources, along with the Assistant Executive Director will conduct a full investigation of the complaint.
  • A letter of finding will be issued within 90 days of the receipt of the complaint, by the Director of Human Resources.
  • The Title VI Complaint form shall be available at The Arc Gloucester main office at 1555 Gateway Boulevard, West Deptford, NJ 08096.
  • A complaint may be filed directly to the Federal Transit Administration at: FTA Office of Civil Rights, 1200 New Jersey Avenue SE, Washington, DC 20590.


  • Investigations of discrimination claims shall be conducted in a way that respects the privacy of all persons involved.
  • All persons interviewed shall be directed not to discuss any aspect of the investigation with others.   Failure of any employee to comply with this confidentiality directive may result in disciplinary action, up to and including termination.
  • Nothing in this policy requires any employee with a complaint of discrimination to present the matter to the person who is the subject of the complaint.
  • In the course of an investigation, it may be necessary to discuss the claims with the alleged discriminator and other persons who may have relevant knowledge.
  • Any employee who believes he/she has been or is being subjected to discrimination, or who believes he/she has observed discrimination, and who reports the matter pursuant to this policy shall not be retaliated against or adversely treated because of the making of the complaint or his/her participation in any investigation.




The Americans with Disabilities Act of 1990 (ADA) is landmark federal legislation that opens up services

and employment opportunities to the millions of Americans with disabilities. The ADA affects access to employment; state and local government programs and services; transportation, and access to places of public accommodation such as businesses, non-profit service providers; and telecommunications.


The Arc Gloucester is committed to ensuring that no person is excluded from participation in or denied the benefits of its services on the basis on their disability as provided by the Americans with Disabilities Act.

The Arc Gloucester management, and all supervisors and employees share direct responsibility for carrying out The Arc Gloucester commitment to the ADA.  The Arc Gloucester Transportation Department ensures accountability in this commitment, and supports all parts of the organization in meeting their respective ADA obligations. Transportation Department coordinates internally with all appropriate offices in the investigation of complaints of discrimination, and takes a lead role in responding to requests for information about The Arc Gloucester civil rights obligations and operations.

What Happens to my ADA Complaint of Discrimination toThe Arc Gloucester?

All ADA complaints of discrimination received by The Arc Gloucester are routed to local area management for prompt investigation and resolution. All complaints received will be investigated, so long as the complaint is received within 180 days from the date of the alleged discrimination. The Arc Gloucester will provide appropriate assistance (online and otherwise) to complainants who are limited in their ability to communicate in English or require accommodation. Complainants will be requested to leave contact information for follow-up about their complaints.

The Arc Gloucester aims to complete investigations into all complaints received, within 90 days of receipt. In instances where additional information is needed to complete an investigation, the investigator will contact the complainant using the contact information provided. Failure of the complainant to provide contact information or any requested additional information may result in a delay in resolution, or the administrative closure of the complaint. The Arc Gloucester has a zero tolerance policy on discrimination and will take appropriate corrective measures in all instances where a violation of The Arc Gloucester non-discrimination policy has been established.

Once a complaint investigation is complete, complainants will receive a notice of finding via their preferred/available mode of contact (phone, E-mail, U.S. post, etc.). If no contact information is provided, a note regarding the outcome of the investigation will be saved on file for a minimum of three years. Complainants can contact The Arc Gloucester Customer Service at any time to check on the status of their complaint.

Title II Modifications to Title VI

The Arc Gloucester recognizes that disabilities are as diverse as the individuals they serve and recognizes the need to make reasonable modifications to its policies, regarding assistance offered to passengers who may require additional assistance to use its services.

Under Title II of the ADA, state and local governments are required to make reasonable modifications to policies, practices and procedures where necessary to avoid discrimination.      

For those riders who require additional assistance, The Arc Gloucester will endeavor to accommodate all reasonable modification requests for such assistance by following procedures outlined below:

  1. Riders must inform The Arc Gloucester of the need and specific type of additional assistance requested at the time ride reservation is made.
  2. Reservationist will advise Dispatcher of the specific rider need/request. Dispatcher will log the information within the client information system and determine the resources required to accommodate rider.
  3. The Dispatcher will evaluate the request and report to the Director of Transportation whether the request is reasonable to perform.
  4. If the Director of Transportation deems the service requested to be unreasonable to perform or to repeat on a regular basis, he/she must cite specific reasoning to support the finding and inform the Transportation Coordinator.
  5. If The Arc Gloucester concurs with the finding of the Transportation Coordinator the rider must be so informed via phone call at least 48 hours before the requested/scheduled trip. The finding must also be communicated to the rider expeditiously by written correspondence. 
  6. Riders may appeal any such decisions by following established ADA grievance procedures. Complaints that a County program, service or activity is not accessible to persons with disabilities should be directed to the Transportation Coordinator, 856-848-8648.
